Also, the plaintiff must prove that damages occurred either physically or financially (medical bills or lost work time due to injury).

The court also considers contributory negligence, which concerns the amount of negligence the victim contributed to the accident. If there is an abundance of contributory negligence found, it is less likely the facility owner will be found responsible.

Statute of Limitations

Statute of limitations is the time frame in which you are legally allowed to file a lawsuit due to a personal injury. In Georgia, a victim must file a lawsuit within two years of the slip and fall accident. The two-year time frame begins on the date of the accident.
